CENTER FOR SCIENCE IN THE PUBLIC INTEREST and PUBLIC CITIZEN HEALTH RESEARCH GROUP DEFEATED IN CASE AGAINST FDA

Washington, D.C. Today the U.S. District Court for the District of Columbia dismissed Center for Science in the Public Interest and Public Citizen’s lawsuit challenging FDA’s qualified health claims process for foods. Julian M. Whitaker, M.D.; Durk Pearson and Sandy Shaw; and Youngevity, Inc. intervened in the case on the side of the FDA to defend the right to make qualified health claims consistent with the U.S. Court of Appeals’ decision in Pearson v. Shalala.

The Court’s memorandum opinion will issue in the near future.
